If no appeals are filed by then, the maps are considered accurate and become the basis for floodplain management regulation. Link explained that these regulations are in draft form in FEMA regional offices now. They attempt to regulate any activity in the 100 year floodplain. The rules will require, that any new residential struction built m the 100 year floodplain will need to have its lowest floor, including basement, to be at or above the level of the 100 year flood. Commercial structures have the option to fully waterproof those levels below the 100 year flood level. All utilities must be flood- proofed. Existing structures are "grandfathered"--no modificahons need to be made to them except if major renovations/improvements are made. According to Link if a property owner wishes to make an improvement to the residential or commercial property that is worth more than 50% of the market value of the structure, that structure then needs to comply with the new regulations governing first floor height. Additional regulations govern development in the floodway--that section of the floodplain usually referred to as river banks which when flooded allows the river to spread out rather than keep rising. No development at all is allowed in the floodway if that development or change will cause an increase in the height of the water level an the 100 year floodplain. An individual or group is allowed however to plan such a development n the floodway if he can cause an equivalent decrease m the level of the 100 year flood somewhere else. Link noted that the final shape of the floodplain regulations is somewhat fluid because of a six month comment period before they are implemented. Notice of this comment period will be published asa legal notice and will follow the closing of the comment period on the floodplain maps. Link was careful to note that these regulations will only go into effect if the county elects to adopt them. When asked why the county would want to adopt these regulations Link responded that failure to adopt would make no flood insurance available to the county or its property-owners and would deny any direct Federal assistance for building or rebuilding in the floodplain. He defined this further as saying that not only would no SBA and FHA loans or VA mortgages be available for floodplain building projects but that no FEMA money would be available for disaster assistance in the floodplain if there were another flood or any other disaster. On the positive side of the ledger Link maintained that flood insurance rates would go down significantly for those property owners complying with the regulations. The county will be responsible for enforcing the new regulations if adopted, but FEMA will provade some assistance Ln the effort. Link explained that 'penalties" (fines) are provided an the regulations for failure to comply with the regulations. Planning Commission executive director Jim Simpson noted after the meeting that enforcement of the new regulahons, if adopted, would be heavily dependent on the building permit application system.
